Terms of Agreement for Track Submission – Electric Sunshine Cult (ESC)
 
Originality of Tracks:

By submitting a track to Electric Sunshine Cult (ESC), the producer affirms that the submitted track is entirely original and that they hold the necessary rights to all components, including but not limited to music, lyrics, and samples.

The producer is solely responsible for clearing any samples, interpolations, or contributions from featured artists.

Distribution Rights:

ESC has the right to distribute the submitted track(s) through various platforms and channels, including but not limited to online music stores, streaming services, and social media.

This agreement is non-exclusive, allowing the producer to distribute their tracks elsewhere unless otherwise agreed in writing.

Territory:
Tracks submitted under this agreement may be distributed worldwide.
 
Monetization & Payment:
For all revenue generated from the submitted track(s):
  • ESC will retain 30%, and the producer will receive 70%.
  • In the case of a featured artist, the featured artist will receive 30%, and the main artist will receive 40%.
  • Blog Team Participation: 10% of ESC’s 30% distribution share will be allocated to the ESC Blog Team. If the producer opts out, ESC will retain the full 30% share.
     
Payment Schedule:
Producers will receive their share of royalties on a monthly basis via our partner Symphonic Distrubution, with a detailed report of revenue and deductions.
Metadata & Credits:
Producers are responsible for providing accurate information regarding:
  • Artist name(s)
  • Featured artists
  • Producers, writers, and contributors
  • Song titles, lyrics, and other relevant credits
     
ESC may use this information for distribution and promotional purposes.
 
Copyright Infringement:
If there is any evidence of copyright infringement related to the submitted track(s), ESC reserves the right to remove the track(s) from its catalog at any time without prior notice.
The producer will be solely responsible for any legal consequences arising from copyright infringement.
 
Promotion and Marketing:
Producers grant ESC the right to use their name, likeness, track information, and artwork (if provided) for promotional and marketing purposes. This may include, but is not limited to, social media posts, press releases, and online advertisements.
Track Placement:
Accepted tracks may be placed for release 2–3 months after approval.
Track Withdrawal / Removal:
Producers may request to withdraw a track prior to release. ESC will honor the request within a reasonable timeframe, but any monetization already accrued will remain subject to this agreement.
Moral / Explicit Content Clause:
ESC reserves the right to reject tracks for content deemed unlawful, harmful, or inappropriate, including explicit content without proper labeling.
Termination:
Either party may terminate this agreement with written notice. Upon termination, ESC will cease distribution of the track(s) within a reasonable timeframe.
